Product Warranty

The following terms and conditions shall govern the Warranty (defined below) pertaining to Str8bat Products (defined below):
1. The new Str8bat products and refurbished Str8bat products shall be collectively referred to herein as the “Str8bat Product(s)”/ “Product(s)”. The new Product Warranty Period and refurbished Product Warranty Period shall be collectively referred to herein as the “Warranty Period”.
2. Str8bat provides limited warranty to the original purchaser that your Str8bat Products that are new shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase or upto 35,000 shots (number of shots) captured with the Product,(“Warranty”), whichever is earlier ("Product Warranty Period"). This Warranty applies when the Product is used under normal conditions and for the purpose for which the Product was designed.
3. If the Str8bat Product is an embedded sticker, the limited warranty will be only applicable when the product is used on cricket bat under normal condition, which included
•⁠ ⁠Embedded sticker not exposed to water including rain droplets
•⁠ ⁠The bat with embedded sticker is not thrown on the hard surface
•⁠ ⁠Embedded sticker is not peeled from the bat
•⁠ ⁠Embedded sticker is only used in appropriate cricketing environment
•⁠ ⁠Embedded sticker is not directly hit by any object Warranty is only applicable for the embedded sticker and it shall be voided if the cricket bat on which it is placed is damaged.
4. If during the Product Warranty Period, you submit a claim for warranty service in accordance with this Product Warranty, then Str8bat will, at its option: (1) repair the Product using new parts or previously used parts that satisfy Str8bat’s quality standards; or (2) replace the Product with a new Product or a refurbished Product that meets Str8bat’s quality standards
5. Repaired or replaced Product has a 90 (ninety) day Warranty period, to be counted from the date, such Product was received by Str8bat for repair/replacement. If the original Product Warranty Period of the Product sent to Str8bat by the customer is still subsisting, then the new Warranty Period for such repaired/ replaced Product shall be the till the expiry of the Product Warranty Period or a period of 90 (ninety) days (to be counted from the date when the Product was received by Str8bat), whichever is later.
6. You understand and accept that In the event of such a defect, to the extent permitted by law, these are your sole and exclusive remedies.
7. This Warranty is effective in the original country of purchase and valid only in the jurisdictions where the Products are sold by Str8bat itself or through its authorized reseller or agent and is valid to the extent permitted by the applicable laws of such jurisdictions.
8. To claim the Warranty , you must reach out to the support desk from our application and follow such procedure/ steps that have been mentioned/explained therein.
9. It is likely that data, software, or other materials will be lost or reformatted during warranty service, and Str8bat will not be responsible for any such loss.
10). Str8bat devices include complex integrated components for which repair, such as cracked body or faulty batteries, may not be possible outside of Str8bat factory conditions, and repair facilities or spare parts may not be available for your product in your region. Therefore, Products submitted to Str8bat for repair may be replaced by refurbished Products, rather than being repaired. In the event repairs are available, refurbished parts may be used to repair the Product . Repair or replacement of Product or such components of Products which are capable of retaining user-generated data may result in loss of that data. You understand accept that it is your exclusive responsibility to transfer, back up or erase Product (as you may deem fit), all personal and other data on the Product before sending it to Str8bat, and that Str8bat shall not be responsible for any loss, use, or disclosure of any data that is on the Product.
11). Str8bat does not warrant that the operation of the Product will be uninterrupted or error-free. These Product Warranties do not cover software embedded in any Product and related services provided by Str8bat.
12). These Product Warranties apply only to the original purchaser of the Product that was purchased from an authorized reseller or sales channel and manufactured by or for Str8bat that can be identified by an authorized “Str8bat” trademark, trade name, or logo affixed to it. Without limiting the foregoing, these Product Warranties do not apply to any:
a). Str8bat products and services other than the Products;
b). Str8bat subscription;
c). product accessories including but not limited to the stickers, charging cables;
d). non-Str8bat products, even if included or sold with a Product, including, without limitation, any counterfeit products;
e). if the Product is not used as per the instructions provided in the manual;
f). Products that are, or Str8bat reasonably believes to be, stolen;
g). consumables (such as batteries);
h). software, even if packaged or sold with the Product or embedded in the Product;
i). third-party products or accessories, including but not limited to such products with the “Made for Str8bat” or “Works with Str8bat” logos. For service or issues related to those products, please contact the manufacturer of such products.
13). Moreover, these Product Warranties do not apply to a Product or part of a Product that has been self-repaired or serviced, altered, refurbished, or modified by anyone who is not authorized by Str8bat, nor does it apply to any cosmetic damage such as scratches and dents.
14). These Product Warranties do not apply to damage or defects caused by:
a). use with non-Str8bat products;
b). accident, abuse, misuse, mishandling, flood, fire, liquid damages, earthquake or other external causes;
c). Warranty does not cover natural wear & tear, usage under extreme conditions; damage due to improper care (accident, misuse or negligence) and damage caused by acts ofGod such as floods, fires or earthquakes;
d). consumable parts, such as batteries, unless product damage has occurred due to a defect in materials or workmanship;
e). normal wear and tear or aging of the Product such as discoloration or stretching; or
f). operating the Product:
1). outside the permitted or intended uses described by Str8bat;
2). not in accordance with instructions and product manual provided by Str8bat;
3). with improper voltage or power supply;
4). if any damage occurs in/on outer surface of the product, including but not limited to cracks, dents or scratches on the exterior cases, screens and other attachments;
5). deterioration of the product caused by normal wearing and tearing, including but not limited to rust or stains;
6). wherein exposure to water is involved;
7). any other circumstances that are contradictory or are not in compliance with business ethics.
15). No Str8bat reseller, distributor, agent or employee is authorized to make any modification, extension, or addition to these Product Warranties. Any such modification, extension or addition to these Product Warranties, shall not be binding on Str8bat and shall not be capable of being enforced against Str8bat.
16). If any term, provision contained herein is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
18). These Product Warranties shall be governed by the laws of India, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction. The Courts at Bengaluru (Karnataka) shall have the exclusive jurisdiction to entertain the disputes pertaining to the Product Warranty.
